Fundamentally, no we aren't; your approach is to decide/judge they're incorrigible through an emotional responce to the crime, with an emphasis on the obvious victim, rather than a balanced approach that considers the possibility, that the criminal's also a victim; besides how do we know their incorrigible before they re-offend? An incorridgible recidivist doesn't automatically deserve prison either. A theif for instance can be tagged and monitored, a fraudster can be denied access to a computer; only a rapist or otherwise dangerous criminal need be confined away from society. So we lock them up, and give them a chance to change; only then, can we get a sense of their incorrigibility. Indeed, in the UK and the USA, it has been monetised and subjected to the lowest bid. How can justice possibly servive that process? It makes the poor poorer and the rich richer; and the rich are much better at hiding their crimes. Therefore the scales of justice are unbalanced and unfair; much like a greedy butcher with a fingure on them and distracting the customer by showing how we should fear the starving among us.

Never seen that movie, but I have seen the one that shows the average joe, plan his/her perfect holiday and look forward to it, all year, with sooo much anticipation of happiness, only to have it entirely spoiled because of a stain on the pillow.

Who said anything about eliminating prison's? What we need to eliminate, for justice to be served, is the fear that every/most violent criminal's are incorrigible; that's a feedback loop that creates more incorrigible recidivist's. Much like making drug use criminal, which just encourages a drug dealer to make money criminally; rather than paying a tax to pay for the justice of the victim's of drug abuse. Instead all of our taxes goes on a war we can't win and prison's that aren't needed.

No, although tactile-emotion synesthesia does resonate with me. Thanks, I'll give it a try and look into that book. I think it's more likely that I'm just a bit thick or just a bit lazy.

Indeed, wrong word the sentence should read "if I'm content, I don't mind what you do..." Wrong word "Contented people don't hurt or steal from each other." People who chase happy, chase the impossible and so can't find a contented state in which to be happy. Otherwise you've nailed it, we just need to find a way to allay the fear of those who can't see past the incorrigible recidivist.

Conquerors and conquered in history...
This brings to mind: No one wants to be conquered, however benevolent their intention's; people just want to enjoy their own culture not be forced into another's. They can be pursuaded, but conquerors' tend to prefer force.

Remove the emotional responses and focus on reparation, for both victim's; anything else strays into revenge. We, normal citizens, don't know what motivates a criminal; it's fairly well known that an abused child can often grow up to be an abuser. The emotional response is to seek revenge on the more recent and obvious abuse, especially when it manifests as particularly brutal and ignore the root cause; it's easier and more satisfying, not too mention feeling safer because they can't possibly do it again, if we lock em up and throw away the key. Given the right motivation/illness we're all capable of criminality, justice for all, means we're all given a second chance. Seeking revenge just damage's your own soul.

I hardly smoke anything these day's, can't afford it, just when I find a bag or when a mate shares, much like JD. Besides, this is a life long problem; I have no problem with learning or exam's, just don't ask me to write an essay. I appreciate your post, but I'm just asking, not trying to find a diagnosis. I'm generally so laid back, it's difficult to find a pulse. 🙂 I often do my best thinking while meditating - often down to the core of a problem; then I try to write it down and the leaking starts, as I seek for the correct wording. To be honest, my life hasn't been free of trauma but I'm content with who I am now. It's just a little frustrating that I can't fully share that understanding. Thanks everyone for the input, it's appreciated...

Then some people are more equal than other's; I'm just saying Justic for all! Because both parties should be considered victim's; the perp is either a victim of life or a victim of an illness, much like the victim of the criminal. A civilised society should be ashamed of the prisons in most of the, otherwise, wealthy countries... That's not to say a prison isn't sometimes necessary, just a kinder version of the one's we got, and to preempt The Daily Mail, yes, more like a holiday home... I'm just saying we should concentrate on the "correct" part of this translation and ignore the rest. My apologies, it often takes a page or two, to get my point across, I wish I could do it in a single post (unfortunately I'm only semi-literate).

I think the legal system, as was designed, is to separate the political need for punishment from the insidious need for revenge. In war a sociopath is a much needed asset.

Neither are they born 'bad', they are born with the potential to be either and then taught to be one or the other; add to this the potential of a bad teacher that leads to a more profound understanding of being good. Why are you troubled by this word? I think all conscious animal's have a sense of self (I just use one word, instead of three). By definition societal living requires cooperation, not imposition (is this a religious bias?), and that requires an innate sense of fairness (as demonstrated by a plethora of studies of various primate's and other animals (wolves et al). Free will doesn't mean we're automatically free to ignore bad influences/teaching, just because some can overcome their past doesn't equate to all being free to do so; some need further input/help. So if we cast them out without the help they require, we doom ourselves to misunderstanding, and the potential of a profound understanding of what's possible; there's no greater advocate/teacher than an ex-smoker, on the harm of tobacco.

Culture has a part to play, but what drives that? That a movie can motivate the impoverished to seek revenge, shows the problem with that society... That old chestnut, god gave us freewill; so any decision we make is our own...
