SCOTUS on SSM

Featured Replies

So far, DOMA is struck down. Prop 8 is dismissed on standing meaning there was no grounds to appeal and thus SSM is once again legal in CA.

Watch the announcements live here.

Same sex marriage is now legal in 13 states (with California once again having it be legal), but the court didn't speak to the broader issue and really didn't even come close to suggesting that all states must treat same sex and opposite sex marriages as equivalent under the law.

I wonder if a constitutional amendment will be needed to make it legal across the entire country. Any thoughts on the ruling or this question?

That's how I understand it, but this should provide a path for more states in similar situations. I would like to see an amendment that borrows from the Declaration in regards to life, liberty and the pursuit of happiness regardless of race, creed, gender or sexual orientation.

But that isn't going to happen anytime soon.

The recognition of marriage in other states part of DOMA wasn't being challenged in this case.

It's incredible that the logic presented by Scalia and Roberts in dissenting is exactly the opposite of what was used to strike down the voting rights act.

sexual preferences is irrelevant to and meaningless to anything,

it's about mentalities.

there needs to be an open mind to humanity it's self.
