actualy I made a mistake and too far from the computer before I realised that:

 

3-Ethyl-4-methyl-pent-3-ene would lock it into trans.

 

doesn`t actualy exist as the pent-3-ene, it could only ever be 1 or 2 in pentene.

 

the rest of my post was ok though.

 

ellaboration: 2,3 methylethyl pent-2-ene would be the locked Trans molecule, as drawn.

 

as it stand it`s neither Cis nor Trans.
